Notice of Privacy Practices
Effective: September 28, 2026
Important: This is a website-ready draft Notice of Privacy Practices. It should be reconciled with the practice's actual EHR, billing, insurance, business-associate, records, and disclosure workflows before clinical use.
Your information. Your rights. Our responsibilities.
This notice describes how health information about you may be used and disclosed and how you may obtain access to that information.
Your rights
- Request to inspect or obtain a copy of health information maintained about you, subject to applicable legal limitations.
- Request correction or amendment of information you believe is inaccurate or incomplete.
- Request confidential communications or reasonable restrictions, where applicable.
- Request an accounting of certain disclosures.
- Receive a paper or electronic copy of this notice.
- File a privacy complaint without retaliation.
Uses and disclosures
Health information may be used or disclosed as permitted or required by law, including for treatment, payment, and healthcare operations where applicable. Other disclosures may include those required for public health or safety, abuse or neglect reporting, judicial or administrative proceedings, law enforcement, workers' compensation, health oversight, or other circumstances authorized by law. Uses or disclosures requiring authorization will not be made without an appropriate authorization, and an authorization may generally be revoked prospectively in writing, subject to legal limitations.
Psychotherapy notes
Psychotherapy notes receive special protection under federal law when the legal definition applies. Authorization is generally required for uses and disclosures of psychotherapy notes except for limited circumstances permitted by law.
Electronic disclosure under Texas law
Texas law provides additional protections concerning electronic disclosure of protected health information. Where a separate authorization is required by Texas law, the practice will obtain it unless an exception applies, including disclosures permitted for treatment, payment, healthcare operations, or as otherwise authorized or required by law.
Our responsibilities
The practice is required to protect the privacy and security of protected health information, provide notice of applicable privacy duties and practices, follow the notice currently in effect, and provide required notification following a breach of unsecured protected health information.

Business Associates and Service Providers
We may use service providers and business associates for practice management, records, communications, billing, technology, and administrative functions. When required by law, appropriate contractual safeguards are used to protect PHI.
Payment, Insurance, and Health Plans
Rubber Duck Therapy may use and disclose PHI as permitted by law to obtain payment for services and to support related payment activities. If insurance is used, selected PHI may be disclosed to health plans, insurers, managed-care organizations, clearinghouses, or other entities involved in eligibility, benefits, authorization, claims, payment, utilization review, coordination of benefits, appeals, audits, or related functions.
Information disclosed for these purposes may include information such as identity and demographics, insurance/member information, provider information, dates and types of service, diagnosis or other billing codes, authorization information, amounts billed or paid, and other information reasonably necessary for the applicable payment activity.
Psychotherapy notes: HIPAA gives psychotherapy notes special protection. Except where a specific legal exception applies, use or disclosure of psychotherapy notes generally requires the individual's authorization and is not the same as routine disclosure of information used to support a claim.
